Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and FindXI ("FindXI", "we", "us", or "our") and govern your use of the FindXI mobile app, the websites at findxi.com and app.findxi.com, and related services (the "Service"). They also serve as the End User License Agreement for the FindXI mobile app.

Please read these Terms carefully. By creating an account, installing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use FindXI. By using the Service you represent and warrant that you meet this age requirement, that the information you provide is accurate, and that you have the legal capacity to enter into these Terms in your jurisdiction.

2. Your Account

You sign in using a third-party identity provider (Apple or Google). You are responsible for maintaining the security of that provider account and for all activity under your FindXI account. You must promptly notify us at hello@findxi.com if you suspect unauthorized use. One person, one account — you may not create multiple accounts to evade rate limits, bans, or FXI balances.

3. The Service

FindXI is a location-based community platform that lets you ask questions, request help, organize meetups, chat with nearby users, and earn or use FXI points within the platform. We may change, add, suspend, or remove features at any time. The Service is provided on an "as is" basis.

4. Acceptable Use and User Conduct

FindXI has zero tolerance for objectionable content and abusive behavior. You agree that you will not, and will not attempt to:

• post content that is unlawful, hateful, harassing, threatening, defamatory, sexually explicit, pornographic, violent, or otherwise objectionable;
• target, harass, stalk, dox, or threaten any person, or impersonate another person or entity;
• post content that exploits or endangers minors;
• post content that infringes intellectual property rights, privacy rights, or any other rights of others;
• use the Service to spam, phish, scam, deceive, or defraud, including fake meetups, fake help requests, or fake verification claims;
• circumvent, abuse, or manipulate the FXI economy, the trust system, the verification system, or rate limits, including by using automated tools, bots, or multiple accounts;
• upload malware, attempt to disrupt the Service, or probe, scan, or test the vulnerability of our systems without prior written permission;
• use the Service in any way that violates applicable law, including export and sanctions laws.

5. User-Generated Content

You retain ownership of the content you post on FindXI ("Your Content"). By posting Your Content you grant FindXI a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, adapt, and otherwise use Your Content for the purpose of operating, providing, and promoting the Service. This license ends when you delete Your Content or your account, except that we may retain copies as required by law and copies that other users have already saved or quoted.

You are solely responsible for Your Content and for the consequences of posting it. You represent that you have all rights necessary to grant the license above and that Your Content does not violate these Terms or any law.

6. Reporting and Moderation

If you see content or behavior that violates these Terms, you can report it from inside the app using the report option on the relevant post, message, or profile, or by writing to hello@findxi.com. You can also block another user at any time, which prevents that user from contacting you or appearing in your feed.

We commit to reviewing reports of objectionable content and abusive behavior, and to removing offending content and suspending or terminating offending accounts within 24 hours of receiving a credible report. We may, at our discretion, remove content or suspend or terminate accounts at any time and without prior notice when we believe these Terms have been violated or when required to protect the safety of our users or the integrity of the Service. Decisions are final.

7. FXI Points

FXI points are an in-platform trust and commitment mechanism. FXI points are not money, are not a currency, are not a security, and have no cash value. They cannot be purchased with real money, cannot be redeemed for cash, and cannot be transferred between users. All FXI flows — including locking, unlocking, forfeiture, and platform credits — are managed by FindXI. We may adjust, freeze, or revoke FXI balances when necessary to correct errors, prevent abuse, comply with law, or protect the integrity of the Service.

8. Identity Verification

You may verify your identity using your passport via NFC. The passport chip is read on your device, and only the verification result, country of nationality, and a timestamp are stored by FindXI. The contents of your passport — name, passport number, date of birth, and biometric data — are not transmitted to or stored by us. Verification is voluntary, but certain features may be limited to verified users.

9. Collateral and Forfeiture

Some features, such as HelpOut requests and meetups, require you to lock FXI points as collateral when you commit to attend or fulfil a request. If you fail to attend or fulfil the commitment within the rules described in the app, the locked FXI points may be forfeited. All collateral operations are managed by FindXI as the platform operator. There are no user-to-user FXI transfers.

10. Intellectual Property

The Service, including its software, design, text, graphics, logos, and trademarks, is owned by FindXI or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the Service except to the extent permitted by law.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

12. Termination

You can stop using the Service at any time and delete your account from inside the app. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if your activity poses a risk to FindXI or other users, or for any other lawful reason. Sections that by their nature should survive termination — including content licensing, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive.

13. Disclaimers and User Responsibility

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.

FindXI is a platform that allows users to connect with each other. FindXI does not vet, verify, endorse, or guarantee the safety, quality, legality, or accuracy of any activity, event, service, goods, or content offered or arranged by users through the Service. FindXI is not an organizer, sponsor, or promoter of any activity posted by users, and is not a party to any agreement, transaction, or arrangement between users.

Identity verification through passport NFC confirms only that a user is a real, identifiable person of a stated nationality. It does not certify the safety, competence, professionalism, insurance, licensing, or quality of any service that user offers, and it does not constitute a recommendation or endorsement by FindXI.

You participate in activities, meetups, and transactions arranged through the Service entirely at your own risk. You are responsible for assessing the safety, trustworthiness, identity, and intentions of other users and their offerings before participating. Exercise the same caution you would when meeting any stranger or engaging any service provider outside of FindXI.

For activities that involve physical risk — including but not limited to sports, adventure activities, transport, travel, outdoor events, food preparation, child or elder care, and the use of equipment — you are responsible for independently verifying the operator's licenses, insurance, equipment, training, and safety practices. FindXI does not perform this verification and makes no representation that any user or activity meets any safety or regulatory standard.

14. Limitation of Liability

To the maximum extent permitted by applicable law, FindXI and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Service. To the maximum extent permitted by applicable law, our total liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of fifty Malaysian ringgit (RM 50) or the amount you paid us in the twelve months preceding the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless FindXI and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, Your Content, or your violation of these Terms or any law or rights of any third party.

16. Apple App Store Additional Terms

The following additional terms apply if you obtain the FindXI app from the Apple App Store. You acknowledge that these Terms are between you and FindXI, not between you and Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide any maintenance or support for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the app. FindXI is responsible for addressing any claims by you or any third party relating to the app or your possession or use of the app, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation. In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, FindXI will be solely responsible for the investigation, defense, settlement, and discharge of any such claim. You represent and warrant that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Malaysia, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Malaysia, except where applicable law in your country of residence requires otherwise.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date at the top and, where appropriate, notify you in the app or by email. Continued use of the Service after an update means you accept the revised Terms.
